Open Question: I am a minor, and do not make min. Wage?

I work at hy-vee as a bagger, I make $7.25 an hour. The state min, wage is 7.75 an hour going up to 8.00 and hour today, the last time i got my paycheck my min wage listed was 7.25 okay i went to my state DOL website and it states The Equal Pay Act prohibits employers with four or more employees from paying unequal wages to men and women for doing the same or substantially similar work, requiring equal skill, effort, and responsibility, under similar working conditions for the same employer in the same county, except if the wage difference is based upon a seniority system, a merit system, a system measuring earnings by quantity or quality of production, or factors other than gender. ok so i do the same ammount work as other baggers that are older then me. so since it does not mention age, i think hy-vee is violating this law. So If i worked 20 hours a week, one month at 7.25 i would have made 580 dollars, but if i was supposed to make 7.75 that is 40 dollars less a month, which after 1 year of working there is a loss of 480 dollars. so what should i do? i think it should call the idol and file a complaint, and if it is true, should sue my company for financial loss more

Women are protected during pregnancy. That is how it should be. This rule of "segregation" is to protect your child. Its not about the woman. I am all about equal rights and wish I got paid what my male co-workers get paid. But complaining about them protecting your pregnancy your baby. Suing for this is ridiculous! Do you agree? Title VII prohibits discrimination in employment on the basis of race, color, national origin, religion or sex, including pregnancy. The consent decree, which still needs court approval, bars the sheriff from discriminating against any employee or applicant of the Bryan County Sheriff's Office, including the jail, on the basis of sex and pregnancy, the Justice Department said. The consent decree also requires the sheriff to implement a policy prohibiting employment discrimination on the basis of pregnancy and to provide mandatory training on the policy. Case study: Nearly 10yrs ago Ali & Usman opened a small chocolate shop named as ‘Royal Chocolates’. Royal Chocolates manufactured high quality chocolates for all special occasions. All the chocolates were manufactured & sold on the premises of the two owners (Ali, Usman). Mr. Ali was responsible for the production & finances while Mr. Usman took care of sales & advertising. At first, both were the only full-time employees & part-time help was used during peek business seasons. However, the demand for their chocolates grew & the business soon became successful beyond their optimistic expectations. As the firm grew, Ali & Usman expanded their retail & manufacturing facilities & hired 15 full-time employees. All employees, except the proprietors, were paid on an hourly basis slightly above the federal minimum wage rate. Despite the low wages, the firm was able to attract dedicated employees who enjoyed working in ‘Royal Chocolates’ small & cohesive environment. Part-time employees were still used to help the full-time employees when needed. However, some of the part-time employees were lacking in aggressiveness & initiative that a small, but growing business required. As Ali put it, some of the workers in the production area seemed to be lacking in performance. Often shelf inventories of chocolates that were especially popular with the customers would be depleted. In addition, some of his sales persons’ help would fail to report for work or would call in sick. Turnover among part-time help was high & both Ali & Usman felt that the firm’s pay policy might be contributing to their personnel problems. Ali decided to institute a ‘piece-rate’ plan whereby production workers would be paid a bonus for packing more than 75boxes of chocolates per hour. In order to ensure quality, production workers were penalized for every box containing smashed or imperfect chocolates that the quality control workers rejected. He hoped that this incentive system would help maintain inventory levels without sacrificing quality. Unfortunately, the plan was a failure because nearly all the production workers complained that the incentive system was too demanding & making extra money was difficult. Royal Chocolates’ problems were compounded when its sales personnel complained that they were forced to accept a straight hourly wage with no chance for any incentive bonus. The production workers, in turn, claimed that they were not compensated fairly relative to the sales workers because sales personnel worked in pleasant surroundings whereas; production workers had to endure heat, noise, & greater safety hazards. A number of workers also claimed that wages in other companies in the community were much higher than those at Royal Chocolates. Royal Chocolates recently received a visit from a state labor department’s representative who threatened the company owners for violating the wage & hourly wage law. It appears that Royal Chocolates had failed to pay overtime to employees who worked over 40 hours during the week during peek seasons. My company has been slowing down a lot. I am required to take mandatory time off since Jan. All employees have health insurance coverage from our employer. Now, I only work two days a week. My boss told me she is not required to give me health insurance by law as I work less than 30 hours a week. If this is the case, can I get health insurance coverage thru the new Stimulus law that was signed by Obama earlier? From what I know, those taxpayers qualifying as an “Assistance Eligible Individual” under the American Recovery and Reinvestment Act of 2009 (“2009 Recovery Act”) are able to pay a reduced premium equal to 35% of the original COBRA premium for up to nine months. The balance of the premium will be subsidized by the government. more

NEW LAW WOULD AUTHORIZE GOVERNMENT CONTROL OF 4 MILLION SMALL BUSINESSES National Center for Policy Analysis The Employee Free Choice Act (EFCA, H.R. 1409, S. 560) does more than take away secret ballot elections: It empowers the federal government to impose contracts on newly organized companies. The government would set wages, benefits, work assignments, promotion procedures, and any major changes to business operations. Because EFCA has no meaningful small businesses exemption, it would authorize federal control of up to 4 million small businesses employing 39 million Americans. Consequently, bureaucrats with no management experience would effectively control these small businesses, says James Sherk, the Bradley Fellow in Labor Policy at the Heritage Foundation. The misnamed Employee Free Choice Act affects both large and small businesses, says Sherk: The National Labor Relations Act (NLRA) has a small business exception, however, this exemption has not been updated for inflation since 1959. It covers all non-retail businesses with gross revenues of $50,000 a year and retail businesses with gross revenues over $500,000 a year. To put those figures into perspective, the average private-sector worker costs his or her employer $56,000 a year in wages and benefits--before the cost of any capital needed to do the job. A business with one worker earning average pay would not qualify, consequently, the law has no meaningful small businesses exemption. The Heritage Foundation used Census Bureau data to calculate how many small businesses EFCA would affect: The act covers 4,180,000 businesses employing 38,934,000 workers. EFCA takes away these workers' right to a secret ballot vote on joining a union -- a consequence that has attracted considerable controversy, says Sherk. I'm work for a local furniture store. When I got hired on they told me that the pay scale was one thing. I then learned that they changed the pay scale several month ago and there are still employees that work there that gets payed on that pay scale. I'm an HR rep for a company I just joined. I'm an african american woman and have been working with my current company for 9 months. The person in this position prior was white and was with the company for 7 years and was making 10,000 more than I am. I am not only doing her exact same job, but am supporting twice as many people. Is this discrimination? Does this violate the Equal Pay for Equal Work Act? Another thing to note is that I am the only african american employee of a staff of 300. I also am the only woman on the management team, and I make the lowest amount in salary. Please help.Original author here. I have 6 years of experience in the field. The other woman had the same. I have a degree in HR she had a degree in Psychlogy. I support twice as many people because he position now support a sister company in additon to what the proir person was supporting. Resolved Question: Do I have a case - possible sexual discrimination / equal pay act violation?

I found a document that stated how much all employees made where I worked ( I am sure it was on there by accident). This document was on a public drive that all employees had access to. I seen that a male that was recently hired was making 2 more dollars an hour than I. I have been there 6 months longer then he was and have more education. We do the exact same job. I took this information to my HR manager wanting to know why he was being paid more. He starts yelling at me about discussing wages. I told him I never discussed wages with any coworkers - this information was public. He wouldn't believe me. The next day he calls me down to his office. He tells me that I am fired for discussing wages which is against policy. I told him what he was doing was illegal. I hope I am right. I have done some research on this and to me it seems like I have a case. These cases are hard to win. Thinking about my own business, I must guarantee a contract of employment for each employee within two months should have a contract of employment that clearly sets out all conditions, duties and responsibilities. According to HM Revenue & Customs each employee within my business must be paid at least: - £5.73 per hour for workers aged 22 years and older - £4.77 per hour for workers aged 18-21 - £3.53 per hour for all workers under the age of 18 Discrimination Equal Pay Act 1970 – This Act states that I must treat both sexes equally. A woman employed in the same job as a man must have the same pay and conditions. Disability Discrimination Act 1995 –This Act states that it is unlawful for an employer to discriminate against a disabled person by refusing to provide adequate services. The Race Relations Act 1976 states that it is unlawful for an employer to treat or fail to prevent the treatment of workers less favourably because of their colour, race, nationality, ethnic or national origins. As an owner of a business ,I must make sure I meet all of these requirements listed above. I should also remember that part-time workers must also be given the same rights and contortions as full-time workers. To meet The Disability Discrimination Act, my business must offer toilets for disabled people, menu in “Brail language” for the benefit of the blind people and each service provided by my business must be equally available for disabled people."  more

Resolved Question: Who Wants Alternative Parties With Equal Say In The Voting Process?

I've been an indie voter for many years since I look at the political parties as cults. I've met so many "brainwashed" zombies from many of the parties that basically get spoon-fed crap from very partisan sources and if anyone presents them with like actual facts and stuff they get go into rants, call you names, and act insane. It's like they're programmed to shut you up in anyway possible because they like their little fake world in the party's reality distortion field and facts would be like saying "Santa isn't real". And sadly the party I was with was one of the biggest ones for having members act like they were in a cult; the Democrats. I've met others from the Republicans to who live in reality distortion fields and will also justify bad stuff, but are much more sociable and don't usually get pissed off at criticism. I'm rather libertarian politically and believe that that people need to be protected from both government and big business, but that government is worse since they can just take everything you own and tend to live on our backs like spoiled greedy brats who want everything, but don't want to work for a living and want us to pay for it! And then take what they steal from us to bribe certain groups of people to be their little whores on election day. I don't want anything from these parasites and the private sector always does a better job too. You know the usual sediment "a government employee is someone who couldn't compete in the private sector". Sponging's easier for them. I don't believe in joining a party because it makes your thinking lazy and distorts reality just like being cloistered in some cult. I like thinking for myself and researching facts from more neutral sources. Resolved Question: McCain and the "Equal Pay For Women" vote?

I have a question about this vote (non-vote, I think is the case) that John McCain has taken flak on. I agree the "women need more education" comment was a bit off the mark, but my question stems from the actual legislation. I just took the time and read the actual text of the proposal and would like people's interpretations of what I found. (1) This is not an "equal pay for women" act, but equal pay for ALL. (2) This act would allow anyone to file this claim against a company regardless of when it happened. Someone could claim they were discriminated against 20 years ago if they so chose. (This thought comes from the fact that it amends the Civil Rights Act of 1964 and several others. Grandfather clause?) (3) The act was defeated primarily because it opens the door for frivolous lawsuits. An argument we all know is feasible. It also yields several questions: (1) By disclosing that she was aware of other employees salaries in a company where salaries are confidential, she violated the company's confidentiality policy, which is most likely a termination-level event. Should she be fired for doing so? Seems they would be within their rights. (2) Should something like this be enacted to open companies up to lawsuits stemming from years past? What happens if the employee has moved on to a different position with different wage levels? (3) Is it more a "McCain against women" issue or the actual substance of the bill that makes people angry about this? Thanks for your insight  more

The United States was created because the British unfairly taxed Americans and regulated our ability to practice free-market commerce. But since day one, socialism has gradually eliminated one free market principle after another. Here is but a short list of creeping socialism in the United States: - Socialized education, started in the liberal la-la land of Massachusetts in the 1830’s, creeping in every state by 1870. - The 14th amendment, ratified in 1868, restricts the right of southern plantation owners to follow free market labor principles. - The Sherman Anti-Trust Act of 1890 which limits the ability of businesses to grow freely. Isn't that the goal of business? - A tax on income, the rightfully earned money of the people, created in 1913 by the 16th amendment - The securites acts of 1933 and 1934, which takes away free stock trading by corporate directors, officers, and employees. - The Taft-Hartley Act of 1935, which severely restricts the right of businesses to fire workers who engage in business-killing practices, like strikes or organizing into unions. - The Fair Labor Standards Act of 1938 put severe restrictions on the ability of children to work as they choose, and severely restricts the right of companies to set their own wages with junk like a minimum wage and overtime pay. - The Equal Pay Act of 1963 and The Age Discrimination in Employment Act of 1967 put even more severe restrictions on the right of companies to set their own wages in a free labor market. Are you as outraged as I am about this erosion of our rights? And all this by a government specifically created by the Founding Fathers to eliminate government intervention into our lives. on? What I mean to say is lets say you want to be a business owner. The reason you should want to be a business owner is because you want to do this. Since your doing this it makes you happy. Just like think like scratching yourself and putting make up you do it freely (ill get to laws soon). So if you want to do it you do it. But lets say you started selling cat food and you made $50 million/year (your company). Then we the people would take this money and add it to the total money made by everyone. If you where an employee or an employer you would get the same salary. So you could be a business owner if people would like your products. I think we as a people would agree on what prices have to be and they would stay the same. Then we can create a government where we all are completely involved. There would be no dictatorship, no president all of us would have the same voting power as the next. In fact we can make this in a form of democracy. Considering we would agree to this “government” (like we supposedly agree in a democracy), we could still have police as a job like we have now and other positions we have now (like fire fighters) . We would all agree on laws like we agree on bills now. So only the people would decide what laws we want, and if the people change there mind then great the laws change. The law system would be complexly an eye for an eye, so actual justice could occur. So if you committed a crime you thought wasn’t a crime then great you would be “punished” with the thing you did. So if thought spitting on people would be ok then you would just be spat on. So if you thought that being a drug dealer is ok then you would also become a drug user. Now if you where a drug user it would be ok because there is no eye for an eye because there is no come back and it is therefore ok. So we can have and let Everyone decide (like referendum or congressman anyway the people would decide which way). The most important factor is that we all would be equal in terms of the law and in terms of access to things. If you are a person with moral ethics then I’m not sure why you don’t believe all men are created equal. If you do, then you shouldn’t (yes shouldn’t not wouldn’t) believe that everyone deserves complete equality. This does not have to be like any source of government. There will not be any leads that have power. We all would have the power. Nobody would get convicted if people thought his act wasn’t a crime because everyone would have the same power. You would not put someone in jail because you would understand that loss of freedmom was not the answer. The key thing to remember is that this source of government would be simple everyone (every single person) would have the same power. There would not be politics like we have today. There would not be a dictatorship, nobody as an individual would create this government we all would do it, so we all would believe it, and it would be the best society out there. Also in your answer can you answer why disagreeing with the fundamental principal of equality is not selfish. See if you believe in an individual then you should also believe in the society. Because the individual is poart of the society, and we all make the society, so every single individual is important to the society. I don’t think any group should be choosing how to run the country or the world, I think we should control it. Now if you say you won’t work well, then so be it. I’m ok with it. You can be as lazy as you want. Great! If that really makes you happy then wonderful, because you’ll be living in this society just like me. And there is even a good chance that you’ll feal guilty and question the meaning of life and contribute. I’m just wondering if people saw and where educated (not propagandized) about the true importance of equality then they just couldn’t say no because then they would fundamentally believe there better then someone and if they did I’d ask them questions like why do you think we should protect you or why do people protect you. Why are odds favoring you, in food health or even life. Why does one die but another lives (in a situation like a mass murder). We say like god help us but we live and others don’t. That’s the whole problem. There is no equality! That’s actually the only problem in society and government. And yes every single right in the constitution (if your thinking USA) would be protected. The legislation was named after Lilly Ledbetter, who was a supervisor at Goodyear Tire & Rubber's plant in Gadsden, Ala. She sued for pay discrimination before retiring after 19 years because she had made $6,500 less per year than the lowest paid male supervisor. However, the U.S. Supreme Court threw out her case, saying she waited too long to file a complaint. The court said that under the 1964 Civil Rights Act, an employee must sue within 180 days of a decision regarding pay if alleged discrimination is involved. The bill sought to change the law, but Democrats could not muster the needed 60 votes to override a Republican filibuster. Obama voted for the equal pay litigation bill in April. McCain was campaigning that day and did not vote. But he has expressed opposition to the legislation, fearing it would open the door to too much litigation. On average, women working in Obama's Senate office were paid at least $6,000 below the average man working for the Illinois senator. As president, Obama will further raise the minimum wage, index it to inflation and increase the Earned Income Tax Credit to make sure that full-time workers can earn a living wage that allows them to raise their families and pay for basic needs such as food, transportation, and housing -- things so many people take for granted. Expand the Earned Income Tax Credit: In both the Illinois State Senate and the U.S. Senate, Obama has championed efforts to expand the EITC, which is one of the most successful anti-poverty programs to date. As president, Obama will reward work by increasing the number of working parents eligible for EITC benefits, increasing the benefit available to parents who support their children through child support payments, and reducing the EITC marriage penalty which hurts low-income families. Under the Obama plan, full-time workers making minimum wage would get an EITC benefit up to $555, more than three times greater than the $175 benefit they get today. Do women get paid less because they are women.....really. If so why don't they sue there employee for sex discrimination ? My opinion there will always be a wage gap. Women drop out and come back in the work force WAayy MMore than guys. Sometime women drop out for years. Most women wouldnt think twice about being a stay at home mom/dropping out job once they have a kid. For women that don't have a kid yet men tend to make more still because they more aggressive negotiators in interview and year reviews. More women seem to not know they can negotiate or just to scared to and just accept the offer that handed to them( By the way Im not saying all men know how to negotiate just more men do it than women). Also even if there starting to be more and more single parent homes there still WAYYY more financial pressure on men. She won all the way up to the Supreme Court, which voted against her. Their ruling was based on a part of the law that said a person should file within 180 days of the discriminatory event, and said that event was when her pay was originally set lower, some 20 years ago, so she was "untimely". Her argument that each paycheck was a continuation of that discriminatory policy fell on deaf ears. Congress introduced the "Lilly Ledbetter Fair Pay Act" as a way of correcting that flawed ruling. It passed the house with flying colors, but was blocked by the Republicans in the Senate. Even McCain said he would have voted against it. Who are Responsible for Backwardness of Tribal ? India has been home to tribals since time immemorial, and they are naturally considered the original inhabitants of India. Their rich history and culture have provided tribes such as Santhal, Munda, Bhil, Meena, Ho Gond and others a distinct identity at the national and international level. The tribal areas of Rajasthan have been home to many tribes such as Bhil, Meena, Bhil-Meena, Damor and Garasia since ancient times. The tribes of Rajasthan have a history full of splendour and valor, and are thus famous for it. The tribal kings established their own kingdoms across the Rajputana. For instance, Dungaria Bhil had Dungarpur, Bansia (Vishna) Bhil had Banswara. Kotia Bhil had Kota, Jetasi Bhil had Abu as their kingdoms, which now constitute districts along these names in modern Rajasthan. Besides, Maharana Pratap, the great Rajputana warrior, had a Bhil warrior as his commander-in-chief, who is still revered by one and all. However, the tribal people have been victim of social, economic and religious discrimination and exploitation notwithstanding their rich history. They have been deprived of education, have been socially looked down upon and rejected, have been made to serve as bonded labour: a fact that has been time and again accepted, officially and unofficially, by politicians, social workers and scholars alike. Jansatta, a Hindi daily, in a news report headlined, “Kendra Anusuchit Jaati-Janjaati ke Liye Vishesh Tantra aur Kanoon Banane ke Paksh Mein” (Centre in Favour of Framing a Special System and Law for Scheduled Castes and Tribes), quoted Union Social Welfare and Empowerment Minister Meera Kumar as saying that more than 16 crore people in India still suffer from the scourge of untouchability. According to Union Home Minister Shivraj Patil, the scheduled castes and tribes are discriminated against even after six decades of India’s independence and affirmative action is needed to change this. In a similar vein, Union Law Minister Hansraj Bharadwaj has maintained that the victims of excesses are paid only lip service. The law minister further said that the discrimination against scheduled castes and tribes should be stemmed at the grassroots level and unless we as a nation change our thinking, these excesses will continue. Usually, non-tribals are held responsible for the backwardness, excesses on and exploitation of tribals. There is some truth to this generalization. But then are the non-tribals only to be blamed for tribal backwardness? Actually, if anybody has to be blamed for tribal backwardness it has to be tribals only. The facts speak for themselves. Take for instance the tribal subplan area of Rajasthan. As the sarpanch, pradhan, district board chairman, all are in most of the cases tribals of this area, so are the MLA, MP and tribal minister who invariably belong to this area. This only shows that they are well represented in governing and legislative bodies, and with a population of about 35 lakh they are not few in numbers. Yet, the common tribal is still struggling to make both ends meet even after 59 years of Independence, and only the tribal politicians, leaders, officials and employees and the youth can be blamed for the backwardness of the tribal society as they together have failed to discharge their responsibility toward their own community. Here, we will explore all this one by one. 1Role of Tribal Politicians As we all know, tribals face social, economic and religious exploitation and excesses which brings the role of tribal politicians into question because they have failed to tackle these problems by mobilizing the community into a movement. The main reason of this failure on their part is the lack of leadership among the tribal community. In addition, after Independence the community panchayats have been usurped by party politics, which has become a bane of the tribal society. The party politics has divided the tribal society into various party ideologies. As a result, most of the tribal leaders, instead of making the tribal development and upliftment their objective, only fulfill their political ambitions. Most of the tribal leaders work to mobilize crowds for their party rallies. They seldom work toward solving the problems of the community. Consequently, even after a period of 59 years, there has been a lack of programmes and schemes to put a planned and special area like the “Adivasi Upyojana Kshetra” (Tribal Subplan Area) on the path of development for the overall development of the tribal community. Of the 150 most backward districts of the country covered under the Food For Work Programme, three districts of Udaipur, Dungarpur and Banswara fall in Rajasthan where the government has to undertake famine relief every year. This only shows that this area has remained still backward because of which many villages lack even basic amenities like drinking water and electricity, there is a lack of irrigation facilities, transport and communication facilities. The tribals of these areas may be found wandering in states like Gujarat, Madhya Pradesh, Delhi to make ends meet. Most of the tribals are unable to benefit from government and non-government run employment schemes for the lack of information and rampant corruption. When some tribal politicians, rising above party politics, dare raise the issues concerning the development of tribals, they are accused of promoting casteism, and their party concerned retaliates by downsizing their political stature and putting checks on them. The threat of denial of tickets for the next elections is the most potent one that makes the tribal leaders helpless. Furthermore, there is no dearth of talented people among tribals, but they are being divided gradually along party lines and social groupings, and they are engaged in pulling down each other and fulfilling their political ambitions. This has only harmed the interests of the tribal society. It has been observed that the tribal leaders from southern Rajasthan have little grip over in the government administration. Lack of education, no influential positions in political parties, lack of awareness about constitutional provisions and rights, lack of information on development programmes and procedures of government departments are some of the reasons for this. The tribal leaders are worried only about their own future and work as yes man of their political masters, to the detriment of the larger interests of the tribal society. 2.Role of Tribal Officials and Employees Tribals living in Rajasthan’s Adivasi Upyojana Area have very low representation in government administration in comparison to non-tribals. They have little representation in Rajasthan administrative services. For instance, out of 600 recruitments so far done for tribals in state RAS and RTS, only 15—that is 2.5 percent were recruited from southern Rajasthan, and only 3 tribals have made it to Rajasthan administrative services. The tribals of this region have never made it to the Indian Administrative Services even after 59 years of Independence. In other words, there are only a handful of tribal officials and employees from this region. And most among these work under pressure and fear, and they never participate in various activities conducted for the prevention of excesses and exploitation perpetrated on tribal society. Keeping in mind that they have raise their children, they think they would work for their community after they retire from job. This is how the tribal officials and employees have failed in discharging their duty toward their society. But when they smell an opportunity to become MLA and MP, they are seen running around for tickets, in other words, they want to become politicians but not social workers. These officials and employees have little interaction with their community members. Most of them have become city dwellers, and they never encourage their children to participate in social and religious activities of their community. In other words, they fail to discharge their responsibility toward their community. The tribal officials and employees posted in this area have to face immense pressure from their political masters and have to work under fear as they are transferred by the politicians to serve their party interests and personal ambitions. This fear keeps them from participating in social development activities. They are thus unable to bring awareness among their fellow tribesmen and set an example before the youth. They only bid their time while waiting to complete their service period. But when they retire it is too late as they are unable to contribute anything substantial toward their community. 3.Role of Tribal Youth Owing to their poor economic condition, most of the tribals send their children to government schools and hostel. Needless to say the government educational institutions are ill-equipped to provide quality education to their wards. For instance, they don’t have qualified teachers in enough numbers, lack well-equipped science labs particularly in rural areas, have no playing grounds, libraries and reading rooms, lack furniture and classrooms. To top it all, students have to face caste discrimination in these institutions that reflects on the results of practical examinations of tribal students. Aware of all these pitfalls of government schools, when the poor tribal families try to get their children good education through missionary schools, some fanatic elements who have a sway upon the larger society dub this act as proselytization and create social and political pressure to deprive their children of education, although this is unconstitutional. How many tribal politicians, officials and social workers have turned their attention toward such occurrences? How many of them have ever bothered to visit the schools and hostels set up in rural tribal areas and tried to do something about the various problems that tribal students face their? How many students have they ever bothered to help and guide? But people venturing into this kind of endeavour are few, and such efforts still few and far between. Even those poor tribal students who try to overcome all difficulties in their studies focus only on getting a government job, and most of the time their efforts go in vain. 4.Role of the Common Tribal Generally, it can be observed that ordinary tribal’s socio-economic condition is so pathetic that all his concerns and efforts focus on making both ends meet, so much so that he is unable to think of his own development let alone making any effort toward resolving the problems the community is beset with. He simply gives up, and hopes that some leader, some official or holy man will descend and deliver us from our pathetic socio-economic condition. The ordinary tribal has left his fate in the hands of government and God. If somebody perpetrates excesses on them and exploits them, they simply bow down before them. If any tribal youth or leader dare raise his voice against such excesses and exploitation, the ordinary tribals fail to throw their weight behind him, as they are in awe of the socio-economic status of the perpetrator. . And if some youth goes to jail for fighting for the dignity of the tribal community or dies for the cause of the tribals, he becomes a part of statistics as his fellow tribesmen, taking such event as something too ordinary to be remembered, forget such sacrifices after a few days. This is one of the biggest faults that lie with the tribal community itself. The Adivasi Upyojana Kshetra is predominantly tribal, people’s representatives are tribals and there are about 1500 NGO which claim to be working for tribal cause, yet the tribals have to suffer excesses and exploitation even after 59 years of Independence. Suggestions The above analysis draws the attention toward important deficiencies of the tribal community which can be removed by the following suggestions: 1.Tribal politicians, officials and employees may have taken advantage of reservations to improve the socio-economic status of their families. But most of them seldom discharge their duty toward the less fortunate fellow tribesmen. Such individuals should be entrusted with special responsibility of contributing toward the socio-economic development of their fellowmen living in poor rural tribal areas. They should be involved especially in educational, health and awareness programmes. And if they don’t fulfill their duty toward the community, they should not be allowed to enjoy the benefits of reservation. 2.Owing to limited resources, the implementation of various schemes designed by the government for the uplift of tribals is an uphill task. As a result of this, the tribals dwelling in poor rural areas are deprived of quality education and health care, thus keeping the tribals backward compared to non-tribals. Various government and non-government studies show that various government schemes meant for the socio-economic development of tribals have failed to reach the intended beneficiaries for lack of adequate staff and resources. The government has now taken an initiative to implement such schemes by involving non-government agencies. But no positive results have emerged from such initiatives. We all know that the missionaries have played a crucial role in providing quality education and health care to the rural poor. It is evident from the socio-economic condition of the tribals of the Northeast, including Assam, Nagaland, Meghalya, Tripura, Manipur, etc., and Jharkhand, which is much better than that of other tribals. The tribals of these areas are contributing their might in a significant way in many countries. It would be advisable to handover tribal development programmes in Rajasthan, Gujarat and Madhya Pradesh to the missionaries, so that the tribal communities of these states also become aware of their human rights and become an equal partners in the socio-economic development along with non-tribals. The no tribal will ever oppose the theory of merit. I also feel that till there is reservation available to them, there abilities will be questioned by the larger society as those who have availed themselves off the benefit of reservation have contributed little significant to the society and the country. It is therefore necessary to make those who are enjoying the fruits of reservation (1) to serve at least for the first five years, after they get a government job, serve in tribal areas and contribute to the welfare and development of the community, (2) adopt a tribal child to raise and educate him and (3) contribute a certain percentage of his earning to development work in tribal areas, such as digging of wells, construction of schools and community centres so that it helps the ordinary tribals lead a life of dignity. And they can say with pride, when time comes, that they are discharging their duty toward their community in return for the benefits of reservation that the government has provided them. 3.Party politics has pushed the tribal panchayats to the brink of ruin. The traditional tribal panchayats have historically played a crucial role in tribal society. It is therefore necessary to revive and strengthen them, as in their absence it would be difficult for the tribal community to reclaim its pride and rightful place in the society. It is apparent from experience that party politics is not going to resolve the problems that the tribal community is besieged with because had the decisions inspired by party politics been beneficial, the tribals would have never been living in pathetic condition even after 59 years of Independence. If any tribal receives lathis in the movements and rallies, held for tribal dignity and resolution of tribal society’s socio-economic problems, is jailed and takes bullets, such person should be revered by the community. We should raise monuments in the honour of such martyrs of the tribal cause, so that they become a role model and source of inspiration, as is the practice in Jharkhand. The community panchayats can also promote community participation in rural development work, so that we don’t have to depend on government alone for our socio-economic development. Every villager should be encouraged to contribute to mobilize resources and remove various deficiencies besetting development work. Villagers should also be encouraged to set up self-help groups so that a positive change is harnessed in their economic condition. 4.The tribal community is depicted in a wrong light in many films, papers and magazines. So it is pertinent for us to expose such tribals and non-tribals, organizations and groups, who are hurting the tribal interests and defaming the community, and give them a befitting reply. Many fundamentalist organizations are working overtime to create a deep wedge in tribal community, making tribals their own enemies. If such dangerous tendency is not checked, the time is not too far when we will have strife on our hands in which tribals will kill taibals. We can on the basis of above say that it will be erroneous to hold non-tribals solely responsible for the backwardness of the tribals of southern Rajasthan. If the tribal community has to suffer excesses and exploitation, and has remained a laggard in development, then tribal politicians, official, employees are as much to be blamed for this sorry state of affairs. It is because these people have use their tribal identity to reap the benefits by becoming politician (MPs, MLAs, district board chairmen, pradhans), government officials and employees. But when it comes to discharging their duty toward their own community they have largely failed. Tribal society will have to suffer excesses and exploitation till every tribal fight for his rights and discharges his duty toward the community. Although the government time and again claims to have spent crores of rupees on the development of southern Rajasthan, the reality on the ground is opposite, as there has been too little development to support such claims. This has led to growing socio-economic and political dissent among tribals of this area. Keeping in view this discontent, some individuals have taken laudable initiative. The foremost among them is Satguru Shri Mohanji Sharma who has been working for the socio-economic uplift of the tribals of southern Rajasthan for the past 15 years. He is guiding the tribal students by spreading awareness among them to help them learn to live with dignity. He is, in fact, in his own way uniting the tribals of this area. There are some politicians who rising above their party lines and ideologies are contributing a lot to the development of tribals. Prominent among them are Tribal Minister Nand Lal Meena, MP Mahaveer Bhagora, Former MP Mahendrajeet Malavia and Tara Chand Bhagora, MLAs Jeetmal Khont and Raghuveer Meena. When the only arguments to believe otherwise come from crazed fans and supermarket tabloids, it is easy to dismiss the possibility that Elvis is still among us. However, the circumstances surrounding Elvis' alleged death are quite mysterious and beg closer attention. As it turns out, there are many concrete reasons to believe that Elvis is still alive. The Gravesite. Elvis' name is misspelled on his headstone. Elvis' full name is Elvis Aron Presley, but on his grave his middle name is spelled incorrectly with two a's. His father would not have let this happen. When Elvis was born, his name was misspelled on his birth certificate, and his father went to great lengths to get it put right. The unique spelling of Elvis' name was important to his family. Elvis' current "resting place" is in between his father and his grandmother and not next to his mother where he had adamantly requested. It is doubtful that the people close to him would allow these things to happen. Elvis is a superstitious man, enough so that he wouldn't tempt fate by putting his real name on a tombstone, or violate the ground next to his mother until he was ready to be placed there for good. Death Certificate. Elvis was very vain, and he was embarrassed about his recent weight gain, an astonishing 50 pounds in the month before his so-called death. Even though he weighed about 250 pounds at the time of his "death," his death certificate lists him at a spry 170 pounds. The original death certificate disappeared, and the current death certificate is dated two months after his alleged death. The Wax Body Theory. This argument is very convincing when the facts are considered. Elvis' coffin required several pall bearers because it weighed 900 pounds. Attendants of the funeral reported that the air around the coffin was rather cool. It is suspected that the coffin contained an air conditioning unit to keep a wax body cool, a wax body that was a replica of Elvis designed to fool funeral-goers. And how did the Presley family get a 900 pound, custom made coffin ready for a funeral that was held on the day after his death? It takes a lot of time to build such an elaborate coffin. And why was the funeral so quickly? Some say that the immediacy was intended to make it as difficult as possible for the people who were Elvis' biggest fans to attend the proceedings. It could be a concern that they might recognize the flaws in the wax replica. Elvis was an 8th degree black belt whose hands were rough with calluses, yet the body in the coffin had hands that were soft and pudgy. The body in the coffin had a pug nose and arched eyebrows {unlike Elvis} and most importantly, one of the sideburns on the "corpse" was loose and falling off. A hairdresser later reported gluing the sideburn back on the body. Unusual Behavior. He came to America as an illegal immigrant from Holland, but through various connections managed to create a new identity complete with a passport, birth certificate, drivers license, and social security number. He would have known how to give Elvis a second life. Aswell as Elvis' ties to the government through his testimony against the "Fraternity", Elvis was known to interact with the President of the United States. He was reported in government documents to use the name John Burrows as an alias when he wanted to travel. Some people believe that Elvis worked for the government as a drug agent. He did, after all have extensive contact with many people in the music business who, as we know, tend to dabble in illegal substances. And, of course, we must allow that Elvis' connections to the government gave him access to the Witness Protection Program. If they can turn the Simpsons into the Thompsons, they can relocate anybody. Orion? Many believe that Elvis couldn't have given up performing completely. Just imagine, after a while the desire to perform would grow once he started his life in exile. The story of Orion supports the theory that Elvis attempted a secret comeback. Shortly after Elvis' alleged death, a masked singer by the name of Orion emerged on the scene. He was big like Elvis, and he sang just like Elvis. Because of the mask no one could tell his true identity. One fan described seeing Orion from near the stage. She claims that Orion left the stage between songs, and when he appeared moments later the sweat was gone from his armpits and back and she thought that his costume looked slightly different. After the song he left the stage, and the original Orion returned. Another fan described how she rushed into a tour bus at an Orion show only to see two Orions in the back of the bus. She claimed that one ducked into the bathroom before she could get a good look at him, but he appeared to look like Elvis Presley. What's even more remarkable is the fictional story called Orion that was written by Gail Brewer-Georgio about a legendary performer who had several identities and wanted to fake his death. The story was written and submitted to the William Morris Agency for publication consideration after Elvis' alleged death and before the real Orion ever performed. As it turns out, there are many ways in which the real Orion mimicked the events as described in the book. For example, the performers' managers had the same name. Also, without knowing it, Brewer-Georgio wrote of events in Orion that had actually taken place in Elvis' life. It was a case of life imitating art. Picking up the Pieces. In 1981, 20/20 did an investigation into the circumstances surrounding the alleged death of Elvis Presley. The investigative report was very convincing. Oddly enough, within two weeks of the report, the singer, Orion, disappeared and was never heard from again. The book, Orion disappeared from shelves across the country. It had been recalled by the publisher which was associated with the William Morris Agency. Incidentally, the William Morris Agency is the same agency that represented Elvis. It seems that Elvis Presley is worth more dead than alive. By faking his death and relocating with a new identity he is safe from his fans and the "Fraternity", the government can make a solid case against the organized crime ring, and RCA, Elvis' family, and Elvis' management can all reap immense financial benefits from the attention. That is... except for one benefit....after nearly 25 years no one has collected on his life insurance policy. Why ????? During his last concert tour in 1977, Elvis spoke of "not looking good tonight", but, he would look good in his coffin. He made comments of being tired of living as he was and how it was going to change. He told of how he would like to be just himself instead of an "image". On August 16th 1977, at 8:00 A.M., Elvis told Ginger Alden that he was going into the bathroom to read. (This bathroom/lounge had it's own back entrance.) For the next six hours no one saw him. Elvis signed for a special delivery letter at 9:30 A.M. At 2:00 P.M. Ginger Alden found the apparent body of Elvis lying on the floor in front of his chair, where he had been reading. She called Al Strada who in turn called Joe Esposito. George Nichopoulous (aka Dr. Nick) was then telephoned. Joe called the fire department, unit 6. The ambulance arrived at Graceland at 2:33 P.M. Paramedics administered CPR, despite rigor mortis. The body was taken to Baptist Memorial Hospital at 2:48 P.M. By 3:00 P.M. Elvis' family members and friends were informed of his "death". Public announcement was given at 3:30 P.M. August 17th, the body was brought back to Graceland for family viewing. The public viewing was from 3:00 P.M. to 6:30 P.M. On August 18th,1977. Tennesse Governor Ray Blanton ordered flags to be flown at half-mast for the duration of the funeral procession. At midday the Graceland gates swung open, a white Cadillac hurse rolled through them, followed by sixteen white Cadillac limousines. QUESTIONS BEGIN How could it take twenty minutes for paramedics to drive sixteen blocks to Graceland if the call came in at 2:33 P.M.? The Medical Examiner's Report states that the body was found with rigor mortis, while the police report states "unconcious". Why would anyone try to give CPR to a rigor mortised body ? The ME report listed the body as weighing 80 pounds lighter then Elvis' actual weight. How could Elvis have passed a physical exam just prior to August 16th if his heart was so enlarged ? How could he have played raquetball for several hours on August 16th, just before his "death" ? ABC's 1979 program on the cover up of Elvis' death stated that all the stomach contents were destroyed. Bill Burkin in his book Elvis World states that officials at Babtist Memorial Hospital had assured him that the stomach contents had been shipped to a California lab to be examined and then on to a lab in Utah, and then ? There are rumors of Elvis' "death" being caused by a heart attack, drug overdose, suffocation in carpeting, suicide and even cancer ! Persons in attendance at Graceland at the time of "death" don't agree on the color of pajamas Elvis was wearing or the posistion of the body. Why did Vernon ask many people NOT to attend the funeral but to come a week later ? Why did Vernon refuse to accept the flag which is usually given to dead war veterans ? Why didn't Elvis have any new jumpsuits made during 1977 ? The handwriting on the death certificate matched Elvis' own writing ! Elvis was very aware of which presribed drugs did not mix well with others. Elvis had glaucoma, and Dexedrine, a drug not to be taken with that condition, was listed as being in his system. Who would prescribe it and why would he take it ? Whose body was autopsied ? Funeral homes don't usually keep solid copper coffins in stock. These coffins weigh in the area of 300 pounds and usually take two months to receive once ordered. This coffin seemed to have been ready. Monte Nicholson, a nineteen year veteran of the Los Angeles Sheriffs Department, wrote a novel called The Presley Arrangement. This novel tells the story of a body that is autopsied, a man resembling Elvis. The man had died of cancer. The body is later returned for private burial, to the man's own family. The man's family are paid to remain silent about the incident. Nicholson explains a government connection. In a 1989 radio interview Nicholson said that even if he knew there was an FBI connection and was told not to say anything, he COULD NOT say. Nicholson also claimed that if he knew the answer to the question, and says he does, he will not disclose his knowledge. He said that if Elvis is alive that his book is pretty close to the truth of what REALLY happened. Was Elvis a DEA (Drug Enforcement Agency) agent ? Elvis can be seen wearing a DEA Staff jacket in several photographs, including one taken in June of 1977, approximately six weeks before his "death". Also Elvis was wearing a jogging suit with the DEA logo on it during the early morning hours of August 16th 1977. When Elvis met with President Richard Nixon he said he had been "studying" the drug culture for over 10 years, he could get into any culture group and be accepted. Elvis said he had gotten alot from the country and he wanted to repay in some way. It would have been a dangerous job and one that an entertainer such as Elvis would not have HAD to do unless he chose to. Many DEA agents pose as "drug users" and "pushers" in their undercover work. Elvis could get to anyone if he appeared to be a "user". In the book Elvis: What Happened? one of the guys wondered if Elvis was ever as whacked out as he seemed to be. Maybe he is a "great" actor after all. Perhaps he deserves an "Oscar". Death threats were issued against Elvis and his family. Those who had leveled those threats had actually broken into Graceland. At times, the FBI were called. Deputy Narcotics Director John Finlator arranged for Elvis to come to his office under the name of John Burrows. Finlator didn't want to give Elvis a badge but the President reversed the decision. On December 21st of 1970, Elvis met with President Richard Nixon in the oval office, Washington, D.C. Elvis had written a letter requesting a meeting and expressed his concerns about the drug culture, hippie elements, the SDS and other groups who were against the establishment. When Finlator finally gave Elvis the badge and promised to issue him consultant credentials, Elvis was overcome with emotion and his eyes became misty. Ten days later he met with the FBI. On the same day, President Nixon wrote Elvis a thank you. Elvis wrote to the President and said, "I can and will do more good, if I were made a Federal Agent at large, and I will help out by doing it my way." More than twenty years ago he burst upon the scene with an impact that was unprecedented and will probably never be equaled. His music and his personality, fusing the styles of white country and black rhythm and blues, permanently changed the face of American popular culture. Late Night with Ross Shafer (August 1988) had a survey that showed that out of 30,000 people polled, approximately 84% believe Elvis is alive. On Monday, August 22, 1988, Harold Schuitmaker, in an item of the Detroit News, said "Elvis is Alive and Living in Kalamazoo." Schuitmaker was a well known Michigan politician and resident of Paw Paw (15 miles from Kalamazoo). The masked singer Orion was at the McMinnville Civic Center and a fan said that she felt that the man onstage and the one who signed autographs were different people. People have reported that someone sounding like Elvis called them on the phone and some hung up because they couldn't believe it. A book titled Elvis: Where Are You? came out of Wilton Manors, Florida around August, 1982 under the name of Al Jefferies. The premise of the book was that Elvis hoaxed his death. Kelly Burgess, a former assistant editor and feature writer with the Detroit News, claimed to have seen Elvis in Kalamazoo, Michigan. She is not living now. In 1988, Heartbreak Hotel starred David Keith as Elvis. (The film had the support of EP Enterprises.) A soundtrack album thanked Jerry Schilling and a special thanks to J.B. In 1987's Robo Cop, a cop is killed, but didn't die. He returns as Robo Cop-a superman hero. It was filmed in Michigan. The firm's new management team announced on Nov.25 that a bonus equal to only 1week salary would be made available to employees this year. Dan thought that this policy was unfair because he and his coworkers planned on the full 2week. The 2week bonus had been given for 10straight years, so it seemed as though the firm had breached an implied commitment. Thus, Dan decided that he would make up the lost bonus week by working an extra 6hours of overtime per week over the next 5weeks until the end of the year. B&L's policy is to pay overtime @ 150% of straight time. For the seniors of America, more choices and more control will mean better health care. These are the kinds of health care options we give to the members of Congress and federal employees. What's good for members of Congress is also good for seniors. New Health Savings Accounts: Effective January 1, 2004, Americans can set aside up to $4,500 every year, tax free, to save for medical expenses. Depending on your tax bracket, that means you'll save between 10 to 35 percent on any costs covered by money in your account. Every year, the money not spent would stay in the account and gain interest tax-free, just like an IRA. These accounts will be good for small business owners, and employees. More businesses can focus on covering workers for major medical problems, such as hospitalization for an injury or illness. At the same time, employees and their families will use these accounts to cover doctors visits, or lab tests, or other smaller costs. Some employers will contribute to employee health accounts. This will help more American families get the health care they need at the price they can afford. Homeland Security, Border Enforcement & Immigration 1. *See Government Reform above. Under President Bush's leadership, America has made an unprecedented commitment to homeland security. 2. Has CONSTRUCTION in process on the first 10 ABM silos in Alaska so that America will have a defense against North Korean nukes. With over 18,000 CBP inspectors and 11,000 Border Patrol agents, CBP has 29,000 uniformed officers on our borders. 5. The Border Patrol is continuing installation of monitoring devices along the borders to detect illegal activity. 6. Launched Operation Tarmac to investigate businesses and workers in the secure areas of domestic airports and ensure immigration law compliance. Since 9/11, DHS has audited 3,640 businesses, examined 259,037 employee records, arrested 1,030 unauthorized workers, and participated in the criminal indictment of 774 individuals. 7. Since September 11, 2001, the Coast Guard has conducted more than 124,000 port security patrols, 13,000 air patrols, boarded more than 92,000 vessels, interdicted over 14,000 individuals attempting to enter the United States illegally, and created and maintained more than 90 Maritime Security Zones. 8. Announced the Student and Exchange Visitor Information System (SEVIS), an internet-based system that is improving America's ability to track and monitor foreign students and exchange visitors.
