It won't really matter any more een for misdemeanors, as most companies are now doing a back ground check. So then you are SOL any way. First of all, I want to point out that there are a lot of misconceptions being reiterated here, so I am posting to clarify several issues. Now I have been hearing about this new law, too. Mostly as a rumor. I haven't had time to check this out. But there is a very good reason behind taking the question off of applications. It is illegal by Federal Law to deny employment based on a crime that is not "substantially related" to the position's duties. There are some exceptions to this law, mostly healthcare, education/childcare, and law enforcement, but really not many. http://www.hirenetwork.org/fed_occ_restrictions.html There are also a lot of state restrictions, so knowing your states policies is also important. But here is the real issue: An employer cannot discriminate against the person for a crime not related to the position (with some exceptions), BUT is legally allowed to ask these questions on the application. So the ex-offender then finds him/herself in a Catch 22 situation: If the applicant lies, s/he risks being fired for being dishonest if hired and the lie is discovered. If they indicate that they did commit a crime, there is a very good chance that the employer will just file the application away. If ever asked, the employer will state that the person's qualifications weren't as good as other applicants and they were not considered. In other words they will lie, thereby breaking the law themselves! That is the irony of the situation. And with these circumstances the ex-offender can't win! So what is happening is that employers are discriminating and therefore breaking the law WHOLESALE. This is something that is entrenched in the corporate culture of most bigger companies. It goes all the way to the top! They all know that they are breaking the law, but there really isn't any way to catch them! So the discrimination that is taking place is not enforceable. The way the system works now is that they are supposed to make their hiring decisions without any consideration of any criminal record whatsoever. They are supposed to hire based on the applicants job-related merits (with exception to any affirmative action, but that's a whole different topic). They are supposed to make an offer BEFORE any drug tests or background checks are done, the actual hiring contingent upon the results. If the applicant accepts a job offer, then they run the tests and checks. When the results are obtained, they may reconsider based on the results and withdraw the offer. If this is done, they are REQUIRED BY LAW to issue what is called an "adverse action letter". The "adverse action letter" explains why an employment offer was withdrawn, and is legally binding. If a person was denied employment due to a conviction that wasn't "substantially related" to the position, they have a great case in Civil Court for employment discrimination. Every major corporation that I have dealt with has followed this policy quite strictly. The problem is that they usually don't have to deal with the dilemna of hiring ex-offenders because of the Catch 22 I mentioned above: Honesty equals no job interview, dishonesty equals an "adverse action letter" for lying on the application. So basically the only way to enforce the law is to remove the questions about criminal convictions from the applications altogether. Would the companies like this? Hell no! But it appears that somebody has finally realized that the companies are breaking the laws themselves to discriminate against ex-offenders. So how are they any better? And the public is getting sick and tired of corporate corruption, anyways. So that, in a nutshell, is the reason why they *might* be taking these questions off of applications. And even though I haven't verified whether this is true or not, it makes sense. :idea: I think initially that the real winners in this are going to be the ex-offenders and, of course, the employment lawyers. There will be a lot of lawsuits, especially initially. Eventually the companies will benefit after they get tired of getting socked with discrimination lawsuits and non-compliance fines, and finally are shown that hiring an ex-offender isn't much different than a non-offender. And finally society as a whole will benefit when there is less crime and recidivism due to lack of opportunity for ex-offenders, and hiring a former offender becomes less of an issue. moreResolved Question: piercings and work???? what do u think...?
okay, i understand that most job settings wont allow any piercings that show (like face, tongue, or even ear piercings) or any that they know about...but i was thinking about it the other day... according to Equal Opportunity Employer, they cant NOT hire based on race, religion, gender, age, etc.... but nose and tongue piercings are part of religion for some people and their culture... soo does that mean that the employer, who doesn't like facial piercings, can say no to a person , who soley has these piercings for a religious matter?... that would go against the law..and that person could sue them for it, right?... but i understand why most employers dont hire ppl like this, cuz there are tons of people with these piercings just 2 have them, and arent for any real reason, but still, when they look at a person adn say no piercings, its like a slap in the face to them if its religious or traditional...i mean, its not like they ask why they have a piercing, and if this is so, then why dont employers just hire ppl with piercings and stop being so judgemental?,, i mean most ppl have the Choice whether or not to have their piercing in.... but what if they dont?.. i dont think that should hinder anyone getting a job.. moreResolved Question: Employing friends and family, how does it fit in with Equal Opportunity?
I work for a multi million pound company, one of the managers has been able to get his son, his wife and his son-in-law very good jobs there too, dispite them lacking in experience or qualifications for the job rolls. I've been there 20 years but my pay has been reduced even though I have been re-trained and got more qualifications. My boss says if you don't like the money, go and find another job elsewhere. But his son-in-law just started working there 3 months ago and gets £100 a week more than I do (he earns what I did 8 years ago). Apparently it is not illegal to lower employees salaries, dispite them progressing qualifications wise. Also my employer keeps adding extra tasks onto my job roll, but without adding extra pay. Do you think I am just winging, or do I have a point? my employer in London shifted me to another office I applied to work to, my former job was on £7.00 per hour while a friend in the new office told he was paid £8.00 per hour (and still is). however when I was shifted there, my pay remained £ 7.00 for a more demanding job ! they just want to save money because of the recession !!!!! Thanks! ----------------- This letter is a formal protest against your hiring practices, which we believe are unethical and illegal. On February 18, 2009 our client possessed an employment application for a position as a police officer with your department. While our client was filling out his application, he discovered the following questions, which are illegal under 42 U.S.C. Section 12112(d)(2)(A) of the Americans with Disabilities Act: 1) Describe in your own words the frequency and extent of your use of alcoholic beverages. 2) Describe the level, frequency and circumstances surrounding any use of marijuana or use of drugs not prescribed by a physician. Our client had a good faith belief that such questions were improper and he refused to answer them. As a result, our client was unable to provide his signature to certify that there were no omissions, as required on your application. The application also requires that “ALL blanks must be filled in,” and that questions are to be filled out “completely and [to] check your answers before submitting.” Thus, your requirements prevented our client the ability to submit his employment application, on the basis that it was incomplete. As a result of our client’s refusal to answer the unlawful questions, he was unfairly denied an equal opportunity to apply for said job and participate any further into the hiring process. Based on this, we believe our client has been victimized by discrimination, since our client is highly qualified for the police officer position and was never given an adequate opportunity to display his qualifications. Under the Americans with Disability Act (ADA), it is unlawful to ask such disability-related questions on employment applications. A law enforcement agency may not ask at the pre-offer stage about the frequency of past illegal drug use; whether the applicant has ever been addicted to drugs; or undergone treatment for addiction. Additionally, a law enforcement agency may not ask at the pre-offer stage about the frequency of past or present alcohol use; whether the applicant has ever had an alcohol addiction; or undergone treatment for addiction. You may argue that the use of alcohol or illegal drugs may be a “disqualifer” for police applicants, on the basis of integrity. We believe that a “disqualifer” of this nature possibly could generally be appropriate, as it may be job-related and consistent with business necessity (though it may not be appropriate for an applicant who has been a successful police officer for several years). You may argue that your questions regarding the frequency and extent of alcohol/illegal drug use are solely to determine the integrity of an applicant, not to determine an addiction [disability]. In those questions, you never ask how many times the applicant performed the actions. A simple answer of “yes” to any of those questions would indicate an applicant lacking integrity. Any illegal drug use would indicate that an applicant is lacking integrity; therefore, we feel that your drug/alcohol questions are used to cause an applicant to divulge an addiction or perceived addiction. You can’t ask pre-offer questions regarding frequency or extent of alcohol/illegal drug use because these inquiries are likely to cause an applicant to divulge a disability or perceived disability, and therefore, such questions are disability-related questions and should not be asked until after a conditional job offer. The Americans with Disabilities Act allows law enforcement agencies to conduct post-offer medical examinations and ask post-offer disability-related inquires. Disability-related inquiries and medical examinations legally go hand-in-hand since they are governed by the same ADA provisions.You would not ask an applicant to do a medical examination before a conditional offer, so why would you ask disability-related questions before a conditional job offer? Sexual harassment is one of the biggest problems facing schools and businesses today. A week rarely goes by without a remainder of the pervasiveness of sexual harassment as a social problem. Sexual harassment is a growing problem in government agencies, schools, and corporations worldwide. Many corporations are adopting new anti-harassment policies, as are schools and agencies. They definition of sexual harassment is any unwanted or inappropriate sexual attention. It includes touching, looks, comments or gestures. A key part of sexual harassment is that it is one-sided and unwanted. Employers and administrators have a duty to investigate allegations of sexual harassment. An increasing number of companies are searching for new ways to protect themselves against these allegations. Many more corporations around the county are adopting their own anti-harassment and implementing ever clearer definitions of sexual harassment to combat this growing problem. Chief Executive Officers should do a variety of things to stop sexual harassment in the workplace. The most important thing is for upper-level management to make it clear to workers that harassment of any kind will not be tolerated. If top managers don't take the issues seriously, employees wont either. Managers must also understand that they are responsible for their employees. Companies need an explicit written policy on sexual harassment that is widely available in the workplace. Most consultants advise companies to do more than just to post the policy on bulletin board. They say that the policy should be repeatedly distributed in new employee orientation packets. Employees should have clear definitions of what sexual harassment includes and what it doesn't include. Many companies are now offering employee training sessions on sexual harassment and many say that the follow-up training is a good idea. A clear process for handling complaints shows that a company takes them seriously. Until 1991, it was hard for women to make allegations of sexual harassment since they often felt that there was nothing they could do about it. During the fall of 1991, the subject of sexual harassment attracted news headlines. Everyone began discussing the issue and emotions ran high. However, the highly publicized hearings that involved Clarence Thomas and Anita hill changed everything. Judge Clarence Thomas was nominated to be a Supreme Court Justice. Supreme Court Justices have their jobs for life and cannot be fired. Before a person can be made a Justice, he or she must be questions and approved by Congress. judge Thomas had once been the head of a U.S. agency called the Equal Employment Opportunity Commission. The EEOC makes sure everyone is treated fairly when applying for a job. It also enforces laws against sexual harassment. Anita Hill is a law professor. She worked with the judge thomas at the EEOC many years ago. A few weeks into the congressional investigation, she came forward and accused him of sexual harassment. She claimed that she used to constantly ask her for dates and spoke to her about pornographic films he had seen. Anita hill said that while she was deeply offended by these remark she felt that she could not complain because thomas was her boss. She though that her career could be in trouble if she made a cuss. Anita Hill was a very believable witness, but Judge THOMAS DENIED HER charges in the strongest possible terms. WHo was telling the truth. The country was divided. The issue was being discussed everywhere. Women from all across the nation told of their experiences with sexual harassment and many mend admitted to being insensitive to this issue. Finally the senate voted to approved Judge Thomas but the vote was close. Many senators had doubts about Thomas character. Others did not think that his career should be destroyed because of one persons story. They said there was not enough evidence to prove that there was wrongdoing. In the end, nearly everyone agreed that sexual harassment is a serious problem to which everyone must become more sensitive. Women are not the only victims are sexual harassment. More and more men are being harassed in the workplace, classrooms, and locker rooms. Men can be victimized by both women and / or other men. THere are other ways to avoid being sexually harassed. For example keep your relationships at work strictly on business level. If you work in the same room as the harasser, somehow create a barrier between the two work stations. Do not ask for personal favors or special treatment from the harasser so that hthat he or she will not feel owed anything. Do not talk about anything personal. Sexual harassment is always wrong . No one deserves it. It is always hurtful to the victim. If everyone confronts this problem men and women would be able to work better together at school, and At work. I am against racism, sexism, and ofcorse feminism. I am one of the few people out there who actually believes that men and women should be treated equal. I don't think women should get any special treatment just because they are women. Just like i wouldn't want any special treatment just because I am a man. Women have everything they need, they have a pro choice president, laws that force employers to employ women and minorities, special scholarships and all kinds of other opportunities that I don't have as a male. I don't complain at all about it, I just want to hear women stop complaining. In my opinion women now have more power than men in america. Don't believe me, look at how many married men act. Thirty-five-year-old Tonia Thomas says she lost her job after failing to use the company-mandated greeting of "Happy Holidays." The Panama City woman and self-described strong Christian has filed a federal complaint that accuses the company of religious discrimination. She has since found another job since her Dec. 10th firing, but for less money and is seeking compensation for lost wages. Her former employer, Counts-Oakes Resorts Properties Inc., says it's no Scrooge. It describes the woman as just a disgruntled employee, but refuses to elaborate. Liberty Counsel, an Orlando-based legal group that advocates for people discriminated against because of their religion, is representing Thomas before the federal Equal Opportunity Employment Commission. Their complaint also accuses the company of harassing and taunting Thomas after she was fired by calling the police to watch her pack her belongings and leave. Thomas could have hard time winning the case, said Thomas Harper, a Jacksonville-based labour lawyer who writes a newsletter on Florida employment law. "I wouldn't think an employee has the right to insist (on saying Merry Christmas) unless that really is a tenet of their faith. She would have to make a strong case that was part of her beliefs, if not, it becomes insubordination," he said. Discrimination against dominant white males will soon be encouraged in a bid to boost the status of women, the disabled and cultural and religious minorities. Such positive discrimination -- treating people differently in order to obtain equality for marginalised groups - is set to be legalised under planned changes to the Equal Opportunity Act foreshadowed last week by state Attorney-General Rob Hulls. The laws are also expected to protect the rights of people with criminal records to get a job, as long as their past misdeeds are irrelevant to work being sought. Equal Opportunity Commission CEO Dr Helen Szoke said males had "been the big success story in business and goods and services". "Clearly, they will have their position changed because they will be competing in a different way with these people who have been traditionally marginalised," she said. "Let's open it up so everyone can have a fair go." Victoria's peak business body expressed concern yesterday about the need for the proposed laws, and questioned if they would undermine the right of companies to make legitimate business decisions. At present, individuals or bodies wanting to single out any race or gender for special treatment must gain an exemption from VCAT. Companies and public bodies accused of discrimination can only be held to account after a complaint has been made. But the proposed changes go much further, allowing the commission to inquire into discrimination, seize documents and search and enter premises after attempts to bring about change have failed. Businesses and individuals would be required to change their ways even if a complaint had not been received. Action could be taken where an unlawful act was "likely to occur", not just in cases where discrimination has taken place. The commission would also have real teeth to enforce its rulings via VCAT and, as a last resort, in the courts. The changes, shown in a Department of Justice report by former public advocate Julian Gardner, would also: EDUCATE people so they know their rights. GIVE more protection to people with disabilities, requiring companies and public entities to reasonably accommodate their needs. GRANT the homeless and people who act as volunteers better protection from discrimination. Victorian Employers' Chamber of Commerce and Industry workplace general manager David Gregory said business supported the objectives of equal opportunity legislation. "But I am concerned and curious about whether these changes mean the commission can second-guess the legitimate business decisions of individual businesses," he said. With all the equal opportunity laws I wonder why women are still grossly underpaid than men and I question what exactly it means. Between the way data is represented does it mean, A. One employer hires both men and women to do the same job, yet pay the women less money. B. Women are doing doing the same exact job as men but are only getting hired by employers who pay less. C. In a general work field, women are getting paid less than men. Which one these is it? Or is it a combination of all three? In my work experience, I find A hard to believe.. for an employer can get away with. I also think C is misrepresentation of data. What do you think?I guess I see the glass ceiling argument, it would somewhat legally alow employers to promote or give raises to men on sexist standards. But it would also mean that they are also technically not doing the same job anymore. This includes: • Businesses must provide all necessary safety equipment and clothing • Making sure that workers have regular brakes • Employers must provide a safe working environment • All businesses must have a written safety policy on display • All businesses must keep temperatures comfortable I must make sure that my own business meets all legal requirements, specifically health and safety regulations and food hygiene legislation. I also need to provide adequate washrooms and toilet facilities and create a hygienic and safe environment for my workers to work in. Contract of employment Anyone employed in the business within two months of starting work must received a contract of employment that clearly sets out their conditions and service such as duties, hours of work, job title and description, holiday pay, sick pay agreement, the amount of pay and how often payments will be made etc. Each contract of employment must include the name of the employer and employee and clearly shows all duties and responsibilities. Thinking about my own business, I must guarantee a contract of employment for each employee within two months should have a contract of employment that clearly sets out all conditions, duties and responsibilities. According to HM Revenue & Customs each employee within my business must be paid at least: - £5.73 per hour for workers aged 22 years and older - £4.77 per hour for workers aged 18-21 - £3.53 per hour for all workers under the age of 18 Discrimination Equal Pay Act 1970 – This Act states that I must treat both sexes equally. A woman employed in the same job as a man must have the same pay and conditions. Women Earn Less Than Men In Today’s Society Women in the United States of America’s workforce today still face inequality in pay; earning less than men in today’s society. Women earn less than men primarily because of sexual discrimination, motherhood, and sexual harassment. However, some scholars refute that women earn less than men. In fact, some scholars argue that women chose to make less income than men, and that women do not make less than men because of sexual discrimination. Women in today’s society should have the same socioeconomic status as men; as well as the same opportunities and pay in the workplace . Women have been fighting for rights for centuries up until now. The first action that took place was the Women’s Right Movement which started in 1848 in Seneca Falls, NY. The convention meeting among the women would be the first step in history towards equal rights for women. The Women’s Right Movement began to change the perception of the way they were looked at in society. The women rights movement focused on equal pay for women, education, and property rights. In the 19th century a bill was passed in 1963 called the Equal Pay Act which deplored sexual discrimination from the workplace. However, women in the 21st century today are still being discriminated against and paid less than men even though it is violating federal laws. Sexual discrimination in the workplace against women is common among corporate businesses and small businesses. Women are sexually discriminated against because of society’s Biglow 2 view of gender roles and being that we live in a male dominated society. Women often face occupational segregation; it is believed that women can’t hold certain positions such as drive a forklift, be a carpenter, a miner or several other occupations because of their gender this is equal to sexual discrimination. For example, men are supposed to be the provider and take car of the family’s finances and women are to be mothers and raise the family and do cooking and cleaning. Women lose thousands in earnings over a lifetime because of sexual discrimination even if the are college graduates. According to the same article it reveals “ A college graduate loses $1.2 million. A young woman who graduated from college last spring and went right to work would, over her lifetime, make $1.2 million less than the young man who received his diploma next to her” ( Women Earn Less..). This proves that being a women and having an education doesn’t guarantee that she will earn top pay because the man next to her that earned the same degree than her will earn more than she does in a lifetime. For example, when women make reports of sexual harassment, they are often demoted or fired because they decided to expose that they were violated. Martin Luther King Jr., Rosa Parks, Malcom X, and the Black Panthers were some of the leaders in the movement. In the beginning of the movement African Americans believed in non-violent protesting but near the end the protesting became violent. Before the movement there were laws of equality but no one followed them. After the movement the government enforced those equality laws way more. The Civil Rights Movement began when an African American woman named Rosa parks refused to move from her seat on the bus and was arrested. The specific protest that she started was the Montgomery bus boycott. African Americans were upset that Rosa parks had been arrested and they all decided to not ride the busses and walk or get rides from employers.At first it was hard for blacks to do this because they would get beaten and arrested but the government was loosing a lot of money and they decided to give the blacks freedom to sit were they wanted to on busses.This law was not followed as well as hopped. When people realized that the segregation on busses was still happening in 1961 they gathered a large group of blacks and whites. These people got several busses and had the whites sit in the back and blacks in the front. They rode the busses all over and were beaten along the way. At one point some of the busses were burned (C).After these protests African Americans finally got their freedom on busses. In 1963 James Meredith was admitted into the University of Mississippi. He felt that even though the university had admitted him that it was still not segregated an that he was alone (J). But the Board of Education felt that they had desegregated their school and was following the laws. In an earlier case that was Brown vs. Board of education they fought for desegregated schools. In the fourteenth amendment it states that facilities can be "separate but equal." They fought that separate schools was not equal (G). Brown had won this case and the schools were to be desegregated. The northern states were starting to desegregate. The desegregation of schools helped African Americans get better paying jobs because they started to get higher education. The income of most African American families had increased (E). When the African American families started to get higher income they started to move into housing in better conditions then in the homes they were forced to live in. Martin Luther King Jr. was a main leader in the movement he fought non-violently. In the march on Washington he gave his famous "I have a dream....." speech. Not long after this he was arrested and continued to fight from jail and wrote a letter (H). When the non-violent protests were not working as well as hoped African Americans started to go for violent protesting. Malcom X and the black panthers were main voices of violent protesting. The Black panthers had written a platform to state what they wanted. They wanted freedom and power to do what they want with their lives, full employment, better education opportunities, better housing, exemption from military, end to all violence toward them, and freedom to the blacks in jail. African Americans also wanted the right to vote. In 1960 Tennessee was the only state that had over 50 percent of blacks voting (B). With all the fighting and protesting done by 1966 at least three more state had over 50 percent of blacks voting(B)> In all the Civil Rights movement gained African Americans social political and economic equality. I know of someone who is being asked to adhere to a separte set of standards in their behavior. While co-workers joke about having dancers come in, he can't even say he went on a date with this guy, without his boss threatening to write him up for 'drawing undo attention', for instance. He's not a flamer, in fact not everyone knows he's gay. This has a number of harmful components. He is being forced in the closet, asked to lie by deliberate omission, told to pander to social prejudice, and being unfairly silenced. I'm sure this kind of thing is probably illegal, but I can only find information on Equal Opportunity laws, and transgender issues. This is happening in Colorado, for the state laws. I want to attend law school, but not one that uses affirmative action. Why should I spend more money on schools that don't see people as unique individuals rather than some arbitrary collective? It's hard enough having ADHD and not being well connected. I can't patronize an institution that thinks diversity is primarily skin deep. If I succeed or fail, it should be because of what I do or don't do, not because of my race or ethnicity. Disadvantage? I've already experienced lazy and incompetent people getting opportunities and a promotion that I was denied simply because they were not white males and I am, when I was clearly more qualified. I don't have as wide a range of choices because of my ADHD, but I'm very conscientious about my work and when I'm good at something, I tend to be very good at it. Most of the lefty commenters seem to be taking the libertarian position, i.e. that women acting as free agents aren't really victimized by prostitution, and that prostitution should be legal. I wonder, though: If individual rights justify legalizing prostitution, why don't they justify working for presently illegal wages, or ignoring laws that oblige members of certain professions to join unions, or that oblige businesses to do business with those unions? If we're to be free agents, enjoying the autonomy of our individual rights, what business does the government have policing private business-owners' attitudes toward race, sex, sexuality, disability, &c.? Did prevailing-wage rules apply to those prostitutes? Were there OSHA inspections? Did their employers withhold their Social Security taxes? Did they follow ADA guidelines? Were they equal-opportunity employers? Did they hang up all those ugly laminated signs from the Department of Mandatory Workplace Posters? All politicians should have at least a certificate or Diploma of BA/MA/PhD in the discipline of DEMOCRACY from a recognize university and a registered licence before they serve the voters of their respective region on behalf of the government. Rules for holding a licence and course curriculum for diploma can be made. Also they should attend seminars, publish paper, writing books, and updated their skills in the same field. They should distributed their resume (attested by government which represent their objectives, qualifications, skills, assets, charges, experience - self and under the supervision of registered politician) etc and proposal (to be submitted to the government) among the voters before polling. Laptop and mobile internet connection services should be given to the each member so that he/she/- can have accesses to the problems solving all the time. 'I cannot imagine that the framers of the 1964 Civil Rights Act intended to say that it's discrimination for a shoe shop owner to say to his or her employee, "I want you to be able to speak America's common language on the job,"' he told the Senate last Thursday. But that's exactly what the Equal Employment Opportunity Commission is trying to do. In March the EEOC sued the Salvation Army because its thrift store in Framingham, Mass., required its employees to speak English on the job. The requirement was clearly posted and employees were given a year to learn the language. The EEOC claimed the store had fired two Hispanic employees for continuing to speak Spanish on the job. It said that the firings violated the law because the English-only policy was not 'relevant' to job performance or safety." Some dear friends of mine, whom I respect very much, say that all illegal immigrants are criminals because they broke the laws that control who may come into this country. And since these immigrants are criminals, we don¡'t want that kind of person here. Sadly, such accusations confuse what is legal with what is moral. American history is filled with people who broke unjust laws and were morally justified in doing so. Legality ≠ Morality The American Revolution was fought by men and women who broke the laws of England and of King George III. Had they been arrested, as was Nathan Hale, they would have been hanged for treason to the Crown. If breaking the law makes one a criminal, then the Founding Fathers were all criminals. But no one still believes that today. Dred Scott and thousands of other slaves defied the Fugitive Slave Acts and ran away, "stealing themselves" from Southern plantation masters in the early 1800's. Those who were arrested were returned to their slave "owners," and anyone found trying to help them escape to Canada was prosecuted as well. Thankfully, many juries exercised jury nullification. Declaring that the law was unjust, juries often refused to convict operators of the Underground Railroad. No one today would claim that a runaway slave was a criminal. Indeed, anyone who forcibly returned Blacks would now be considered guilty of having collaborated with the slave masters — albeit legal slave masters. In the 1930's there were hundreds of Jews who came to American shores aboard the SS St. Louis, forcibly sent back by immigration quotas to perish in Hitler's concentration camps. Thousands or millions of potential refugees watched in desperate disappointment. But suppose those passengers had defied immigration law and jumped ship in Miami harbor. Would anyone today call them criminals? I think not. Indeed, those who returned Jews to their persecutors might be considered guilty of collaborating with villainy — albeit legal villainy. Treasures of the Earth It may be illegal for people to seek freedom and opportunity in this country, but it isn't immoral. I admire the courage of immigrants who leave all that is familiar to them, risking life and limb on stormy seas and deadly deserts, in order to move to a strange land where everything is unfamiliar and potentially hostile. Most of our ancestors moved for freedom and opportunity and we are the beneficiaries. Thank God they weren't arrested and sent packing, as were violators of the Chinese Exclusion Act. Indeed, we might wonder if we could have mustered the same measure of courage if we had been in their shoes. It is convenient and simple to exclude new newcomers by calling them criminals. But the real reason is much more complex. For some people it is a fear of other races. For others it is a fear that newcomers might work hard and will "take" jobs. Others fear the opposite — that newcomers will not work hard and will take welfare. In the first case, many immigrants are great entrepreneurs who offer jobs to Americans. Other immigrants take jobs, but they never "take" jobs that are not willingly offered to them by eager employers. I often ask audiences: "Suppose you are an employer and you know only one thing about two job applicants in front of you: one is native-born and the other is an immigrant? Who would you expect to be the harder worker?" Audiences overwhelmingly favor the immigrant. Why? Americans are surely good workers. But the very act of migration is seen as proof of vigor, ambition, determination, and courageous self-reliance. Choice: Employees Right, Employers Right Americans have a moral right to make these choices for themselves — as employees and as employers. Says Robert W. Tracinski, a senior writer for the Ayn Rand Institute: "The irrational premise behind our nation's immigration laws is that a native-born American has a 'right' to a particular job, not because he has earned it, but because he was born here. To this 'right,' the law sacrifices the employer's right to hire the best employees — and the immigrant's right to take a job that he deserves. To put it succinctly, initiative and productiveness are sacrificed to sloth and inertia. "The 'American dream' is essentially the freedom of each individual to rise as far as his abilities take him. The opponents of immigration, however, want to repudiate that vision by turning America into a privileged preserve for those who want the law to set aside jobs for them — jobs they cannot freely earn through their own efforts....Any immigrant who wants to come to America in search of a better life should be let in — and any employer who wants to hire him should be free to do so." To the legalist, however, who places law above moral right, the employer who hires as he pleases is a criminal. The legalist wants stricter penalties against employers who defy state mandates on hiring. Once again this is reminiscent of historic laws that were used to criminalize employers who dared to hire Blacks, women, and Jews. Violations were illegal, maybe, but not immoral. Welfare Magnet? But what of the immigrant who takes welfare? Isn't this a burden on society that must be stopped? Yes, it is. But politically powerless newcomers are no more responsible for the welfare system in this country than they are responsible for the tyranny and corruption in a country that they are fleeing. Okay, stop the flow of welfare, but at the same time remove the plethora of [anti-] labor laws that make it difficult for newcomers to be hired. It is wrong to assume that most immigrants come to America to get on the welfare gravy train. If this is true, then immigrants would be moving away from states with the lowest welfare and into states with the highest welfare. My research (The Journal of Private Enterprise, Spring 2004) demonstrates that the opposite is true. In overwhelming numbers, both the native-born population and the foreign-born population through the decade of the 1990's moved away from states with the highest welfare and into states with the lowest welfare. While there are some high profile exceptions, most immigrants seek opportunity, not welfare. The brilliant economist, Julian Simon, demonstrated that immigrants are a great source of productivity and economic growth. They always have been. Simon declares that most wealthy industrial nations will depend on the productivity of immigrants to provide revenues for the increasingly costly welfare demands of a native-born population. Moral Principles Governments do not decide morality. Governments behave morally when upholding moral action and behave immorally when suppressing moral action. Morality is based on principles far more constant and profound than the variant whims of majority votes. The people who understood this best, were those rebels who defied the law of the day to pen these words: "WE hold these Truths to be self-evident, that all Men Are Created Equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty, and the Pursuit of Happiness." There is a department at my wifes job that is hard to get into unless you are related to the boss or someone already in that department. There are certain requirements for this job in which my wife meets all of the requirements. The problem is that when these jobs become available, they do not usually post these jobs to the employers or to the outside. They have been hiring people that is either th boss's son, related to a supervisor, or people they are friendly with. My wife knows of a few examles of people they hired (presumeably without an interview) that do not even meet the minimum requirements. One of the requirements is that they must be former military (it is a government contracted job). The position has a few people that were never in the military (like the boss's son). I dont think this is classified as a government job so I don't know what the law is pertaining to this. Does anyone know the law? This is in the state of Kentucky. More health care choices: As President Bush stated, "…when seniors have the ability to make choices, health care plans within Medicare will have to compete for their business by offering higher quality service [at lower cost]. For the seniors of America, more choices and more control will mean better health care. These are the kinds of health care options we give to the members of Congress and federal employees. What's good for members of Congress is also good for seniors. New Health Savings Accounts: Effective January 1, 2004, Americans can set aside up to $4,500 every year, tax free, to save for medical expenses. Depending on your tax bracket, that means you'll save between 10 to 35 percent on any costs covered by money in your account. Every year, the money not spent would stay in the account and gain interest tax-free, just like an IRA. These accounts will be good for small business owners, and employees. More businesses can focus on covering workers for major medical problems, such as hospitalization for an injury or illness. At the same time, employees and their families will use these accounts to cover doctors visits, or lab tests, or other smaller costs. Some employers will contribute to employee health accounts. This will help more American families get the health care they need at the price they can afford. Homeland Security, Border Enforcement & Immigration 1. *See Government Reform above. Under President Bush's leadership, America has made an unprecedented commitment to homeland security. 2. Has CONSTRUCTION in process on the first 10 ABM silos in Alaska so that America will have a defense against North Korean nukes. Has ordered national and theater ballistic missile defenses to be deployed by 2004. 3. Announced a 9.7% increase in government-wide homeland security funding in his FY 2005 budget, nearly tripling the FY 2001 levels (excluding the Department of Defense and Project BioShield). 4. Before DHS was created, there were inspectors from three different agencies of the Federal Government and Border Patrol officers protecting our borders. Through DHS, U.S. Customs and Border Protection (CBP) now consolidates all border activities into a single agency to create "one face at the border." This not only better secures the borders of the United States, but it also eliminates many of the inefficiencies that occurred under the old system. With over 18,000 CBP inspectors and 11,000 Border Patrol agents, CBP has 29,000 uniformed officers on our borders. 5. The Border Patrol is continuing installation of monitoring devices along the borders to detect illegal activity. 6. Launched Operation Tarmac to investigate businesses and workers in the secure areas of domestic airports and ensure immigration law compliance. Since 9/11, DHS has audited 3,640 businesses, examined 259,037 employee records, arrested 1,030 unauthorized workers, and participated in the criminal indictment of 774 individuals. 7. Since September 11, 2001, the Coast Guard has conducted more than 124,000 port security patrols, 13,000 air patrols, boarded more than 92,000 vessels, interdicted over 14,000 individuals attempting to enter the United States illegally, and created and maintained more than 90 Maritime Security Zones. 8. Announced the Student and Exchange Visitor Information System (SEVIS), an internet-based system that is improving America's ability to track and monitor foreign students and exchange visitors. Over 870,000 students are registered in SEVIS. Of 285 completed field investigations, 71 aliens were arrested. 9. This week, the US-VISIT program began to digitally collect biometric identifiers to record the entry and exit of aliens who travel into the U.S on a visa. Together with the standard information, this new program will confirm compliance with visa and immigration policies. 10. Eliminated INS bureaucratic redundancies and lack of accountability. 11. Split the Immigration and Naturalization Service into two agencies: one to protect the border and interior, the other to deal with naturalization. 12. Signed the workplace verification bill to prevent hiring of illegal aliens. 13. Established a six-month deadline for processing immigration applications. 14. Information regarding nearly 100% of all containerized cargo is carefully screened by DHS before it arrives in the United States. Higher risk shipments are physically inspected for terrorist weapons and contraband prior to being released from the port of entry. Advanced technologies are being deployed to identify warning signs of chemical, biological, or radiological attacks. Since September 11, 2001, hundreds of thousands of first responders across America have been trained to recognize and respond to the effects of a WMD attack. Judiciary & Tort Reform 1. Is urging federal liability reform to eliminate frivolous lawsuits. 2. Killed the liberal ABA's unconstitutional role in vetting federal judges. The Senate is supposed to advise and consent, not the ABA. 3. Is nominating strong, conservative judges to the judiciary. 4. Supports class action reform bill which limits lawyer fees so that more settlement money goes to victims. Politics 1. His leadership resulted in Republican gains in the House and Senate, solidifying Republican control of both houses of Congress and the presidency. 2. HUD has started pilot programs in 11 states. 8. Committed US funds to purchase medicine for millions of men, women and children now suffering with AIDS in Africa. 9. Heeding the words of our own Declaration of Independence, the president laid out the non-negotiable demands of human dignity for all people everywhere. On January 29, 2002, he said, "No nation owns these aspirations, and no nation is exempt from them. We have no intention of imposing our culture. But America will always stand firm for the non-negotiable demands of human dignity." We were drafting to fill the ranks."Pick up a rifle, learn English and a citizen you shall be!" We did it during the Civil War, Vietnam and why not NOW? The other alternative: You want citizenship, prove (like my wife had to) that you will not become a burden to the state. (What happened to THAT rule? I had to sign a 10-year affidavit of support to get her in from Korea.) One way to ensure there are no more burdens to the state is to make each illegal get sterilized It will stop anchor babies and make them think twice about flouting our immigration laws.
